1. Der Transport von Pferden mit der Firma Hofmann ist auf der Unternehmerseite im Schadensfall auf maximal 50.000.-€ mit 100.000.-€ der komplette Zug versichert.
Horses transported by Hofmann Horse Transport are insured up to a value of € 50 000 maximum, or market value, whichever is less, up to a maximum of € 100 000 for the entire load.
2.Der Transport von Pferden erfolgt grundsätzlich auf Risiko seitens des Auftraggebers, solange dem Unternehmen vorsätzliches oder grob fahrlässiges Verhalten nicht nachgewiesen werden kann.
The owner of the horses transported do so at their own risk, unless damage was caused by the transporters deliberately or grossly negligently.
3.Der Transport von Pferden, die sich als schwierig im Verhalten beim Transport oder beim auf- und abladen erweisen, wird immer grundsätzlich auf Risiko des Auftraggebers ausgeführt.
Horses which are difficult to handle, load, unload or travel are always transported at the risk of the owner.
4.Sollte sich ein Pferd oder mehrere Pferde beim verladen, beim ausladen oder während des Transportes verletzen, liegt das Schadensrisiko voll beim Auftraggeber, es sei denn, dem Unternehmen kann grob fahrlässiges Verhalten nachgewiesen werden.
Any injury incurred by a horse / horses during handling, loading, unloading or during transport is entirely at the risk of the owner, unless the injury was caused by the transporters deliberately or through gross negligence.
5.Schäden am Fahrzeug, die durch ein sich unruhig oder unbändig aufführendes Pferd entsteht, gehen zu lasten des Auftraggebers und oder Halter des / der Tiere.
And damage to the vehicle will be invoiced to the owner of the horse.
6.Die Höhe des entstandenen Schadens wird durch ein Gutachten festgestellt und dem Auftraggeber/Halter in Rechnung gestellt.
The amount due for such damage caused to the vehicle will be determined by an independant expert and invoiced to the owner of the animal.
7.Sollte der Fall eintreten, dass ein Tier nicht transportwillig ist und der Transport abgebrochen werden muss, werden die kosten der Leerfahrt in voller Höhe in Rechnung gestellt.
If a horse proves to be impossible to load or travel safely then the loading / travelling will be stopped and the full cost of the journey is still due to the transport company.
8.Zahlung der Transportkosten erfolgt grundsätzlich in bar beim Eintreffen!!! Ist der Auftraggeber nicht der Eigentümer, so haftet für die Zahlung der Auftraggeber!!
Payment of the transport invoice is always due upon delivery of the horse in cash (unless previously agreed otherwise in writing). If the person comissioning the transport is not the owner of the horse he or she is responsible for the cost of transport and it’s payment.
Gerichtsstand für beide Seiten ist Rottweil.
